US Prosecutors Ask for Dismissal of Moussaoui Case

VOA News

26 Sep 2003, 05:39 UTC

U.S. prosecutors are urging dismissal of the court case against
suspected

terrorist Zacarias Moussaoui, so they can appeal against his right to

question fellow al-Qaida prisoners.

Federal prosecutors asked U.S. District Judge Leonie Brinkema Thursday
to

dismiss the indictment against Mr. Moussaoui so they can appeal to a

higher court.

Mr. Moussaoui faces the death penalty if he is convicted of conspiracy
in

the terrorist attacks against the United States on September 11, 2001,

when air hijackers seized four passenger jets and crashed three of them
into

New York City and Washington.

The defendant, a French citizen of Moroccan descent, has requested the

right to question three senior al-Qaida operatives. He says they can
prove

he was not involved in the September 11 attacks.

The U.S. government says giving Mr. Moussaoui access to the men could

harm national security by unveiling classified information.
